THE ADVANTAGE

To keep a step ahead of the competition, holders of intellectual property assets have much to gain from developing and entering into joint research, licensing, and other types of international collaborative relationships, the end goal of which is to commercialize core technologies.

For European IP holders, it means taking that next step or, for those already active in North America, finding new opportunities to advance and commercialize core technologies and to access all corners of the American marketplace, one of the world's largest, most dynamic, and most lucrative markets.

For American IP holders in the areas of bio- and medical technologies, such a relationship can mean getting a step ahead by proving the value of a technology in earlier clinical trials completed by world-class researchers at the world-class research facilities found in Northern and Central Europe. It can also mean obtaining earlier regulatory approval than can otherwise be obtained in the United States through the FDA. The result, in such case, is an earlier establishment of revenue streams for a company due to an earlier market entry in Europe. Those revenues, in turn, can be put to use to meet the company's other needs, both in the U.S. and elsewhere.

For both American and European holders of IP assets, whether large or small, such relationships can mean a reduced risk, reduced cost manner of entry into new markets abroad. By licensing IP assets or entering into a collaborative relationship, revenue streams can be increased while great savings of costs can be achieved. The immense cost of forming and opening a subsidiary abroad, equipping it, hiring employees, and running a business in a far off country can all be avoided.

Other savings can be realized merely by choosing these markets. Unlike many markets of the world, these markets - the markets of North America and Northern and Central Europe - are characterized by corporate transparency, enforcement of intellectual property rights, respect for the rule of law, and stable governments, currencies, and institutions.

In all cases, especially for small and medium-sized companies, the development of a joint research or licensing relationship abroad can be read by investors as further proof of the competence and foresight of a company's management team and concrete evidence of the value of a company's technology.

Once a transatlantic relationship is formed, whether based in Europe, the U.S., or both, significant value is added to each participating company and efforts to increase the interest level of domestic investors are greatly enhanced. Most often, the end result is increased revenue streams through licensing, for example, and the attraction of additional capital from actors, domestic and otherwise, previously unwilling to invest. This, in turn, works to ensure the relevance and success of your company and its technology in a global marketplace.
